jQuery problem

first of all compliments on the theme i really love it end have rated it 5 stars (i have Orion Html version)

i have bought http://codecanyon.net/item/facebook-traffic-pop/142429 end it seems the have problem whit the them
i
fist searched the support forum of this mod but there i found a article
where he tels people to ask for fix of the wordpress-html writer

this is a coppy of what he told to user:

Your site is currently running multiple versions of jQuery (3 from
what I can see). This causes serious issues (normally complete failure)
of plugins that rely on it and is normally caused by a bad theme or
plugin loading it incorrectly. It is not possible that this plugin is in
culprit as it loads through the WordPress hook system making it
impossible for the plugin to load jQuery if its already running. Non
WordPress plugins running into this issue are normally caused by
incorrect installation and including to many copies.

99.99% of the time the theme is the issue. We ask that you contact
your theme developer and ask for a patch, especially if you got the
theme from ThemeForest.

to test this i have removed all jQuery the theme end add the facebook jQuery end than it worked fine !!

so my question is can u help me whit this problem
